Schedule a meeting with Mary, try and build trust with her by making conversations. talk about people on the pictures,

"...

Ensure that you are aware when is the best time to meet with Mary. Arrange to meet with Mary and ensure that you have some photographs of Brian and Paul. Take time to speak with Mary, to speak with her at her own pace, to develop rapport and trust. Ask Mary if she can tell you about the people in her life who are important to her. Ask Mary to look at the photographs you have brought with you. Is Mary able to recognise the people in the photos, does she become emotional when viewing the images.

"...

Paul is not considering Mary's views/wishes. He appears not to have consulted with her regarding her views.

"...

Decision appears overly restrictive and prevents adult exercising her own choices without due consideration of her wishes. Has Mary's view been sought?
What are the risks associated to Brian's involvement which would justify this action contravening her rights? Doesn't appear reasonable or proportionate based on current information. Has there been a meeting with care home manager, Paul and Mary to determine Mary's wishes and also discussion with them on implications on Brain visiting.

"...

Has Marys past and present wishes been taken into consideration

"...

Has Paul asked or ascertained Mary's thoughts and feelings or her past and present wishes or is Paul acting in his own interests due to his prejudice against Brian? We must consider making a supported decision but if Mary is lacking capacity Paul MUST consider how Mary would have decided if she had capacity. In this instance it appears Paul is guilty of exercising a substitute decision in breach of the UNCRPD

"...

It is Paul that has decided that Brian cannot see Mary. It should be Mary's decision if she wants to see Brian

"...

Has Mary expressed her wish to see Brian? Care home should be seeking Mary's wishes and supporting them.

"...

Does excluding Brian benefit Mary
What would Mary's wishes have been before incapacity

Paul is not taking Mary's wishes into account. He is not following the AWI Principles and as Mary's attorney he should be challenged on this.

"...

Paul is not carrying out his mum's wishes so therefore should Brian contact the OPG to challenge how Mary's PoA is being managed?

"...

Paul is acting on his own wishes, not his mum's. Brian would be more aware of Mary's more recent views on what she wants for the future than her son. Is there a reason Paul has excluded Brian - was Mary and Brian's relationship a good one?

"...

Mary should be supported to make a decision about Brian......Does she ever ask about / miss Brian? Seems that Paul is preventing this out of personal grievance against Brian.

"...

Care home support workers have opportunities to chat with Mary, gleaning insight into her wishes, perhaps monitor her mood. if she has photos of Brian/family, does she seem enriched or distressed when she sees the photos? She previously lived with and was cared for by Brian, so Paul's decision to exclude Brian from visiting does not seem to be in Mary's best interest. Support Mary to decide her preference. Can this decision (perhaps other decisions also?)+ Paul's status as PoA be challenged?

"...

What are Mary's wishes, does Brian want to visit as Mary wanted him in him in her life. Mary's behaviour could change wondering why Brian has'nt visited. Low self esteem.

"...

Marys thoughts and wishes should sought, depending on this a decision that she makes should be the main concern, what is the up to date medical diagnosis of Marys condition with regard to her ability to make decisions that are in her best interests, has her son discussed this matter with his mother and informed the nursing home what his mum told, preferably in front of nursing home staff
